Associate Olesia Kryvetska comments on legal implications of the consultative referendum in the Netherlands concerning the Agreement on Association between the EU and Ukraine

Requested by online-resource “AgroPortal”, Associate Olesia Kryvetska provided for the commentary on consultative referendum in the Netherlands concerning the Agreement on Association between the EU and Ukraine, scheduled to be carried out in April 2016.

Olesia Kryvetska holds that, from legal point of view, the results of the consultative referendum have no mandatory power. However, from the political point, it must never be underestimated.

According to parag. 3 of Art. 12 of the Law on Consultative Referendum (Wet raadgevend referendum), in case when abovementioned held referendum does not approves the Law on ratification or approval, the Parliament of the Netherlands shall as soon as possible render a decision on expediency of annulment of respective Law or even withdrawal from the international treaty, if it is already in force for the Netherlands.
Therefore, the Referendum in the Netherlands may “freeze” the process of entering into force of the Association agreement with Ukraine.
