The International Centre for Settlement of Investment Disputes (ICSID) announced the decision of the ICSID ad hoc Committee in proceeding concerning annulment of previous arbitral award on the claim of Joseph Charles Lemire against Ukraine dated 28 March 2011.

The International Centre for Settlement of Investment Disputes (ICSID) announced the decision of the ICSID ad hoc Committee in proceeding concerning annulment of previous arbitral award on the claim of Joseph Charles Lemire against Ukraine dated 28 March 2011.

According to the decision of the ad hoc Committee of ICSID as of 8 July 2013 arbitration decision on this case is not subject to cancellation and becomes final.

The arbitration case was initiated in 2006. In this case the owner of the radio station “Gala” Joseph Lemire claimed numerous violations by Ukraine of the Treaty between the United States and Ukraine Concerning the Encouragement and Reciprocal Protection of Investments. Joseph Lemire put forth numerous requirements regarding the settlement agreement dated 20 March 2000 that was previously concluded between him and State of Ukraine as a result of consideration of the former dispute.
