Upon request of the legal diary Yuridicheskaya Practika (“The Practice of Law”) Senior Associate Anna Gladshtein made a comment on the critical questions of the WTO Dispute Settlement Body’s decision in China-Export restraints on raw materials. The WTO Panel interpreted Art. XI:2 (а) of the GАТТ 1994 in the abovementioned report. Art. XI:2 (а) allows to apply temporarily prohibition ror restriction to either prevent or relieve a critical shortage of of foodstuffs or other products essential to the exporting contracting party. This issue was especially important for Ukraine in the context of setting the grain export quotas in 2010.
